Welcome to JAMTOYZ. These Terms of Service, together with any policies referenced below, govern your access to and use of the JAMTOYZ website, online store, products, services, content, features, forms, purchase options, Trade Zone submissions, customer account tools, and related services.
JAMTOYZ is a website, store, and customer-facing brand operated by Design-Tactics, LLC d/b/a JAMTOYZ ("Design-Tactics," "JAMTOYZ," "we," "us," or "our"). By visiting our website, placing an order, creating an account, submitting information, contacting us, participating in Trade Zone, or otherwise using our services, you agree to these Terms and to our Privacy Policy, Return and Refund Policy, Shipping Policy, Purchase Options Cancellation Policy, Legal Notice, and any other policies posted on our website.
If you do not agree to these Terms, you should not access, browse, submit information through, or purchase from JAMTOYZ.
1. About JAMTOYZ
JAMTOYZ is an independent retailer specializing in Monster Jam toys, die-cast trucks, playsets, collectibles, parts, accessories, certified pre-owned items, and related products. JAMTOYZ is operated by Design-Tactics, LLC.
Unless expressly stated otherwise, JAMTOYZ is not affiliated with, sponsored by, or endorsed by Monster Jam, Feld Motor Sports, Spin Master, Marvel, Disney, or any other third-party brand owner. Product names, logos, trademarks, characters, vehicle names, and related marks belong to their respective owners and are used for product identification, compatibility, and descriptive purposes only.
2. Eligibility and Use of Our Website
By using our website or services, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for any minor dependent to use our website through your account, device, or payment method.
You agree to use our website only for lawful purposes and in accordance with these Terms. You may not use our website in any way that violates applicable laws, infringes the rights of others, interferes with the operation of the website, bypasses security features, abuses discounts or promotions, misuses our checkout process, or harms JAMTOYZ, our customers, our employees, our service providers, or our systems.

You agree that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs through your account.
We may refuse service, suspend access, cancel orders, or restrict accounts if we believe information provided is inaccurate, fraudulent, abusive, incomplete, or otherwise violates these Terms.
4. Products, Product Information, and Availability
We make reasonable efforts to accurately display product names, descriptions, images, pricing, conditions, scale, series, model numbers, availability, and other product information. However, product information may contain errors, omissions, or manufacturer changes. Product colors, graphics, packaging, finishes, and appearance may vary due to production changes, photography, lighting, screen settings, packaging variations, or manufacturer updates.
Product listings may include new, certified pre-owned, used, open-box, loose, repaired, inspected, refurbished, replacement, custom, collector, clearance, discounted, final sale, or limited-quantity items. The condition and included components of each item are governed by the product listing and any applicable policy.
We reserve the right to change product descriptions, pricing, availability, quantities, product groupings, collections, promotions, and product information at any time without notice.
5. Collectibles, Packaging, and Condition Expectations
Many products sold by JAMTOYZ are toys, collectibles, or collector-focused items. Packaging condition may matter to some customers, and we encourage customers to review product photos, descriptions, and condition notes carefully before purchase.
Unless a listing specifically states otherwise, packaging may show normal retail shelf wear, handling marks, corner wear, scuffs, scratches, dents, bends, creasing, sticker residue, price sticker marks, minor crushing, factory tape variation, or other cosmetic packaging imperfections.
For collectible items, packaging condition is not guaranteed to be mint unless the listing expressly states that the packaging is mint or collector-grade. If packaging condition is important to you, please contact us before purchasing.
6. Jam Garage Certified / Certified Pre-Owned Items
Some products may be sold as Certified Pre-Owned, Jam Garage Certified, used, open-box, inspected, loose, repaired, or previously handled items. These items are not represented as factory-new unless the product listing clearly states otherwise.
Jam Garage Certified or Certified Pre-Owned items are inspected by JAMTOYZ to confirm condition, completeness, and general presentation to the best of our ability. These items may have been previously owned, opened, displayed, handled, removed from packaging, repackaged, repaired, or otherwise prepared for resale.
Certified Pre-Owned items are intended to be in the condition described in the product listing. Minor cosmetic differences, packaging absence, packaging wear, handling marks, or small variations may be present depending on the item and listing. Any included parts, accessories, packaging, or extras are limited to what is shown or described in the product listing.
Certified Pre-Owned does not mean manufacturer-certified, factory-refurbished, or manufacturer-warrantied unless expressly stated. JAMTOYZ inspection is an internal condition review and does not create a manufacturer warranty.
7. Parts, Accessories, Repairs, Compatibility, and Custom Items
JAMTOYZ may sell replacement parts, accessories, bodies, chassis, wheels, tires, repair parts, custom items, modified items, and related components. Compatibility is the customer’s responsibility unless we specifically confirm compatibility in writing before purchase.
Customers are responsible for reviewing product descriptions, photos, measurements, scale, model information, and compatibility notes before placing an order. Some parts may require installation, tools, modification, or adult assistance.
Custom, modified, repaired, loose, replacement, or parts-based items may have small cosmetic differences, production variations, installation marks, or fitment differences. JAMTOYZ is not responsible for damage caused by improper installation, misuse, modification, incorrect compatibility assumptions, or use outside the intended purpose.
8. Orders and Order Acceptance
When you place an order, you are making an offer to purchase the selected product or products. We reserve the right to accept, decline, cancel, limit, modify, or refuse any order for any reason, including but not limited to inventory errors, pricing errors, product information errors, payment issues, suspected fraud, high-risk orders, shipping restrictions, quantity limits, address concerns, duplicate orders, or availability issues.
An order is not accepted until payment is processed and we confirm the order. We may contact you using the email address, phone number, billing address, or shipping address provided at checkout if there is an issue with your order.
Please review your order carefully before submitting it. Once an order has entered processing, packing, label creation, or shipment preparation, we may not be able to cancel, edit, combine, split, or modify the order.
9. Pricing, Promotions, Discounts, and Billing
All prices are listed in U.S. dollars unless otherwise stated. Prices, discounts, promotions, shipping rates, free shipping thresholds, and product availability are subject to change without notice.
The price charged for a product will generally be the price displayed at the time the order is placed, subject to correction for errors. We reserve the right to correct pricing, typographical, promotional, shipping, availability, or product information errors at any time, including after an order has been submitted.
If an order is canceled due to an error, any amount paid for the canceled item or order will be refunded to the original payment method when possible.
You agree to provide current, complete, and accurate billing and payment information. By submitting payment information, you represent that you are authorized to use the payment method provided and that all charges incurred by you will be honored by your payment provider.
10. Payment Processing and Third-Party Payment Services
Payments may be processed by Shopify Payments, Shop Pay, PayPal, credit card networks, installment providers, fraud prevention tools, or other third-party payment processors. Your use of those services may be subject to separate terms, privacy policies, credit approvals, fees, or payment obligations from the applicable provider.
JAMTOYZ is not responsible for third-party payment provider decisions, declined transactions, payment holds, installment plan approvals or denials, account restrictions, financing terms, or payment processing delays.
11. Purchase Options, Preorders, Backorders, and Cancellations
Some products may be offered through purchase options such as preorder, coming soon, backorder, reservation, installment, subscription-like purchase tools, or other checkout options when available. Any purchase option may be subject to additional terms shown at checkout or on the applicable product page.
Estimated release dates, restock dates, shipment dates, and arrival dates are estimates only and may change due to manufacturer delays, supplier delays, carrier delays, allocation changes, import delays, or other factors outside our control.
Cancellation rights for purchase options are governed by our Purchase Options Cancellation Policy and any terms shown at checkout. Once an order has entered processing, packing, shipment preparation, or fulfillment, cancellation may no longer be available.
12. Shipping and Delivery
Shipping options, costs, free shipping thresholds, and estimated delivery times may vary by order, destination, selected shipping method, carrier, product size, and order value. Delivery dates are estimates only and are not guaranteed unless expressly stated in writing.
Customers are responsible for providing a complete and accurate shipping address. We are not responsible for delays, failed deliveries, lost packages, or additional costs caused by incorrect, incomplete, outdated, inaccessible, or undeliverable addresses provided by the customer.
Once an order is transferred to the shipping carrier, the carrier is responsible for transit and delivery. We are not responsible for delays caused by carriers, weather, holidays, natural disasters, incorrect routing, delivery exceptions, unavailable recipients, customs, emergencies, or events outside our reasonable control.
If a package is returned to us due to an incorrect address, incomplete address, refusal, failed delivery attempt, unclaimed package, or similar issue, additional shipping charges may apply. Refunds, reshipments, or replacements are subject to our Shipping Policy and Return and Refund Policy.
13. Returns, Refunds, Exchanges, and 30-Day Return Policy
Returns, refunds, and exchanges are governed by our Return and Refund Policy and any product-specific return terms shown on the product page. Unless otherwise stated, eligible items may be returned within 30 days in accordance with our posted Return and Refund Policy.
Returned items must be received in the condition required by our Return and Refund Policy. Items returned used, damaged, incomplete, missing parts, missing accessories, missing packaging, altered, swapped, materially different from the item shipped, or otherwise not in required return condition may be refused, partially refunded, or subject to a restocking fee or diminished value adjustment where permitted by law and our posted policies.
Certain items may be final sale or limited-return items, including but not limited to custom parts, replacement parts, loose parts, used items, repaired items, clearance items, discounted items, opened items, trade-in items, and items marked final sale.
Original shipping charges, expedited shipping charges, return shipping charges, and handling costs may be non-refundable except where required by law or expressly stated in our posted policies.
14. Trade Zone Submissions, Offers, and Store Credit
JAMTOYZ may offer a Trade Zone program that allows customers to submit Monster Jam trucks, collections, parts, or related items for potential cash offers, store credit offers, or other purchase/trade opportunities.
Submitting a Trade Zone request does not guarantee that JAMTOYZ will make an offer, accept the items, purchase the items, provide store credit, or complete a transaction. We may accept, decline, limit, revise, or withdraw any Trade Zone offer at our discretion.
Trade Zone offers are based on the information, photos, condition, completeness, authenticity, market demand, rarity, resale potential, and other details available at the time of review. Any preliminary offer is subject to change after the items are received and inspected.
Final value may change if the received items do not match the original submission, are damaged, incomplete, counterfeit, altered, missing parts, improperly described, improperly packed, or otherwise different from what was represented.
If JAMTOYZ provides a prepaid shipping label for approved Trade Zone items, the seller remains responsible for packing items safely and securely before shipment. JAMTOYZ is not responsible for damage caused by inadequate packaging, improper packing, or loss before items are received at our facility.
Cash payments, store credit, or other consideration may be issued only after items are received, reviewed, accepted, and approved by JAMTOYZ. Store credit has no cash value unless expressly stated and may be subject to expiration, limitations, or separate terms where permitted by law.
15. Gift Cards, Store Credit, Rewards, and Promotional Credits
Gift cards, store credit, promotional credits, discount codes, and rewards are subject to the terms shown at the time of issue and any applicable law. They may not be redeemable for cash except where required by law.
We reserve the right to refuse, cancel, or adjust credits, discounts, promotions, rewards, or gift cards that were issued in error, obtained fraudulently, abused, duplicated, transferred improperly, or used in violation of these Terms.
16. Product Safety, Age Recommendations, and Customer Responsibility
Many products sold by JAMTOYZ are toys, collectibles, or hobby items and may include small parts, wheels, axles, accessories, packaging materials, sharp edges, plastic components, metal components, magnets, batteries, or other parts that may present hazards if misused.
Customers are responsible for reviewing and following manufacturer age recommendations, warnings, labels, safety instructions, and supervision guidelines. Products should be used only as intended.
JAMTOYZ is not responsible for injuries, damage, choking hazards, misuse, improper installation, unsafe handling, modification, failure to supervise children, or use inconsistent with product warnings or manufacturer instructions.
17. Manufacturer Warranties and Third-Party Protection Plans
Except as expressly stated in a product listing or written policy, products are provided on an "as is" and "as available" basis. Manufacturer warranties, if any, are provided by the manufacturer and not by JAMTOYZ unless expressly stated.
Some products may be eligible for third-party warranties, protection plans, service contracts, or coverage offered by outside providers. Those warranties or plans are administered by the third-party provider, not JAMTOYZ, unless otherwise stated.
Customers are responsible for reviewing the terms, coverage, exclusions, claim procedures, and limitations of any manufacturer warranty or third-party protection plan.

You represent that you own or have the right to submit the content and that the content is accurate, lawful, and does not infringe the rights of any third party. We may remove, edit, reject, or decline to publish submitted content at our discretion.

By using our website, placing an order, submitting a Trade Zone request, creating an account, signing up for marketing, or contacting us, you acknowledge that personal information may be collected, used, processed, stored, and shared as described in our Privacy Policy.
Personal information may be shared with Shopify, payment processors, shipping carriers, fraud prevention providers, analytics tools, customer service tools, marketing providers, review tools, and other service providers necessary to operate our business.

Our store is powered by Shopify, which provides the e-commerce platform that allows us to sell products and services to customers. Payment processing, checkout, analytics, shipping tools, email tools, review tools, marketing tools, accessibility tools, and other features may be provided by Shopify or other third-party service providers.
Although Shopify helps power our store, purchases made through JAMTOYZ are transactions between you and Design-Tactics, LLC d/b/a JAMTOYZ. Shopify is not responsible for our products, inventory, order fulfillment, shipping, returns, refunds, warranties, customer service, Trade Zone submissions, or any transaction between you and JAMTOYZ.

23. Errors, Inaccuracies, and Omissions

You agree to indemnify, defend, and hold harmless Design-Tactics, LLC d/b/a JAMTOYZ, Shopify, our affiliates, owners, officers, employees, contractors, suppliers, vendors, service providers, licensors, and partners from and against any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising from or related to:
